These Terms of Use ("Terms") govern access to and use of the prospectai platform ("Service"), provided by algarit.pt ("we"). By creating an account or using the Service, the user ("Client") accepts these Terms.
prospectai is a B2B sales prospecting platform assisted by Artificial Intelligence that researches companies in public sources, qualifies them and prepares e-mail proposals for the Client to review and send.
The Client undertakes to use the Service lawfully and, in particular, to:
The Service uses AI models. The results (qualifications, texts) may contain inaccuracies and do not constitute advice. The Client is solely responsible for reviewing and sending communications. Responsibility for the content actually sent lies with the Client.
The Client may configure their own API keys (e.g. Google Gemini). The use of these keys is subject to the terms of the respective providers and the costs they charge. The keys are stored in encrypted form.
The Service, the brand and the software are the property of algarit.pt. The data entered and the leads generated belong to the Client. The Client is granted a limited, non-exclusive and non-transferable licence to use the Service during the subscription.
We make reasonable efforts to keep the Service available, although interruptions may occur for maintenance or due to external causes. The Service is provided "as is", with no guarantee of specific commercial results.
To the maximum extent permitted by law, algarit.pt is not liable for indirect damages, loss of profits or loss of data. The total aggregate liability shall not exceed the amount paid by the Client in the 3 months prior to the event.
The processing of personal data is governed by the Privacy and Cookies Policy. When algarit.pt processes data on behalf of the Client, it acts as a processor under article 28 of the GDPR.
We may suspend or terminate access in the event of a breach of these Terms, non-payment or misuse. The Client may cancel at any time through algarit.pt.
These Terms are governed by Portuguese law. For the resolution of disputes, the courts of the district of [•] shall have jurisdiction, with waiver of any other, without prejudice to the consumer's mandatory rights.
We may update these Terms. The date at the top indicates the version in force; continued use after changes implies acceptance of them.
